1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and SIGITMK Marathon ("we," "us," "our," or "Organizer"), governing your access to and use of the website located at sigitmk.us (the "Site") and your participation in SIGITMK Marathon 2026 (the "Event"). By accessing the Site, submitting any form, or participating in the Event, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site or participate in the Event.

2. Eligibility

Participation in the Event is open only to individuals who meet the following criteria:

• Minimum age requirements: 18 years for Full Marathon, 17 years for Half Marathon, 15 years for City Run (10K), 12 years for Fun Run (5K), and 6–11 years for Kids Dash (with parent/guardian consent)
• Physical fitness: Participants must be in good health and physically capable of completing their chosen distance. We strongly recommend consulting a physician before participating
• Legal capacity: By registering, you represent that you have the legal capacity to enter into this agreement

3. Use of the Website

3.1 Permitted Use

You may use the Site for personal, non-commercial purposes related to SIGITMK Marathon. This includes browsing event information, submitting registration interest, and contacting the Organizer through provided channels.

3.2 Prohibited Conduct

You agree NOT to:

• Use the Site in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any portion of the Site or its systems
• Use automated systems (bots, scrapers) to access or collect information from the Site without prior written consent
• Interfere with or disrupt the Site's operation
• Submit false, misleading, or fraudulent information
• Reproduce, modify, or distribute any content from the Site without written permission

4. Registration and Payment

4.1 Registration Process

Submitting a registration interest through the Site is not a guaranteed slot. Registration is confirmed only after the Organizer validates your submission, receives payment (where applicable), and issues an official confirmation. Confirmation will be sent to the email address you provide.

4.2 Fees and Pricing

Registration fees are listed on the Site and are subject to change. Pricing displayed at the time of your confirmed registration will apply. All fees are non-refundable except as expressly stated in the refund policy provided upon confirmation.

4.3 Refunds and Transfers

Refunds, slot transfers, and deferrals are governed by the official race rules communicated to confirmed participants. Generally:

• Refunds may be available under specific circumstances, subject to administrative fees
• Slot transfers to another person may be permitted before the registration lock deadline, subject to approval and fees
• Requests must be submitted in writing to hello@sigitmk.us

5. Race Participation and Safety

By participating in the Event, you acknowledge and agree that:

• Running is a physically demanding activity with inherent risks
• You are responsible for your own health and physical condition
• You will comply with all race rules, marshal instructions, and safety guidelines
• The Organizer provides medical support but is not responsible for pre-existing conditions or undisclosed health issues
• Participants who fail to meet cut-off times may be directed to safe transport

6. Intellectual Property

All content on the Site—including but not limited to text, graphics, logos, images, and software—is the property of SIGITMK Marathon or its licensors and is protected by intellectual property laws. You may not use, reproduce, distribute, or create derivative works from any content without prior written consent from the Organizer.

7. Third-Party Links and Advertisements

The Site may contain links to third-party websites and display advertisements from third parties, including Google AdSense. We do not control and are not responsible for the content, privacy practices, or terms of use of any third-party site. You acknowledge that any interaction with third-party content is at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law:

• The Site and all content are provided "as is" without warranties of any kind
• We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Site or participation in the Event
• Our total liability shall not exceed the amount paid by you for registration, if any

9. Indemnification

You agree to indemnify and hold harmless SIGITMK Marathon, its officers, directors, employees, volunteers, sponsors, and agents from any claims, damages, losses, or expenses arising from your use of the Site, your participation in the Event, or your violation of these Terms.

10. Privacy

Your use of the Site is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Site, you consent to the practices described in the Privacy Policy.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page. Your continued use of the Site after any changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Indonesia, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be resolved in the courts of Jakarta, Indonesia.
